I now endorse the Colonial Secretary's Letter to Mr Smale informing him of the leave granted.
Your Lordship will perceive thence and from the subsequent Correspondence that the extent and Commencement of Mr Smale's leave was not finally fixed at six months from the 11th Instant without more than one change.
The great object of this Arrangement was to prevent his resuming his seat on the Bench, because in his present Condition it would be to the last degree very uncertain whether he might not refuse or be unable to preside in the Supreme Court, in which case, I fancy, there would have been no alternative but to suspend him if the Medical Adviser of Government considered him quite unfitted for his duties.
Fortunately these difficulties have been avoided, and Mr Smale has decided on leaving the Colony by the Mail Steamer of the 11th Instant, after this despatch. None of the unpleasant questions, therefore, can arise, which his actual stay in the Colony during his leave might have led to.
